By accessing or using the Spanly platform and services ("Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.

2. Description of Services

Spanly provides an observability platform for Model Context Protocol (MCP) servers, including telemetry collection, real-time tracing, error tracking, performance monitoring, and analytics dashboards.

3. Account Registration

You must create an account to use our Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account.

4. Acceptable Use

You agree not to:

Use the Services for any unlawful purpose
Attempt to gain unauthorized access to any part of the Services
Interfere with or disrupt the integrity or performance of the Services
Reverse engineer, decompile, or disassemble any part of the Services
Use the Services to transmit malicious code or content

5. Pricing and Payment

Paid plans are billed monthly. Prices are subject to change with 30 days notice. Overage charges are billed at your plan's per-request rate. All fees are non-refundable except as required by law.

6. Data Ownership

You retain ownership of all telemetry data you transmit to our Services. We do not sell your data to third parties. We may use aggregated, anonymized data to improve our Services.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Services. We may perform scheduled maintenance with reasonable advance notice. Paid plans include an uptime SLA as specified in your plan details.

8. Limitation of Liability

To the maximum extent permitted by law, Spanly shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Services.

9. Termination

Either party may terminate these terms at any time. Upon termination, your right to use the Services will immediately cease. We will retain your data according to our data retention policy and applicable law.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email or through the Services. Continued use of the Services after changes constitutes acceptance of the updated terms.
